With more yacht arrests and sanctions occurring over the course of the weekend, we took a closer look at the legal implications for the arrest or freezing of private vessels, speaking to a number of maritime lawyers to get a more in-depth understanding of current events. All of those we spoke to pressed that these are unprecedented times both in yachting, and on legal terms.While a number of the sanctioned Russian oligarchs and elites own superyachts, at this time it remains only the 156-metre <a data-gid="gid://syiq/Yacht/5967" href="#managed-by-system" rel="noopener noreferrer" target="_blank" title="Dilbar156.0m (511'10&quot;)Lürssen Yachts2016">Dilbar</a> and the 85.5-metre <a data-gid="gid://syiq/Yacht/2485" href="#managed-by-system" rel="noopener noreferrer" target="_blank" title="Amore Vero 85.5m (280'6&quot;)Oceanco2013">Amore Vero</a> that have been publicly named by any international body. James Jaffa of <a data-gid="gid://syiq/Company/6454" href="#managed-by-system" rel="noopener noreferrer" target="_blank" title="Jaffa & Co (Company)">Jaffa &amp; Co</a>. commented, “While there is a widespread aversion to dealing with Russian individuals, legally you can still engage in commerce with Russians as long as neither they, nor their bank, are named on the sanctions lists.”&nbsp;This is important because it means that non-sanctioned Russian-owned yachts are still able to pay crew and release funds in order to maintain the operations of the vessel. On the other hand, lawyers speculate that sanctioned yacht owners cannot legally release funds in order to operate their vessels and therefore the yachts will be crippled by the legislation, whether the yachts are named or not.Read: <a data-gid="gid://syiq/Article/54681" href="#managed-by-system" rel="noopener noreferrer" target="_blank" title="How might the war in Ukraine impact the superyacht industry? Yachts are, of course, arrested regularly – but vessels are usually free to go once financial security has been provided. Security is typically in the form of a bank guarantee. The current situation is more like confiscation than detention. The aim is the deprivation of assets rather than the settlement of a debt or other legal claim.”Jaffa added that under the sanctions it becomes illegal for any company, including a bank, or individual to engage in a financial transaction with a sanctioned individual. “The sanctions have a particularly wide net and even indirect financing of sanctioned individuals can lead to very significant fines and jail time.” This means that while the vessel’s owner is being sanctioned, finances cannot be provided for the vessel, meaning that its operation is essentially impossible.Read:&nbsp;<a data-gid="gid://syiq/Article/54694" href="#managed-by-system" rel="noopener noreferrer" target="_blank" title="Seized Russian superyachts: The first two yachts seized in Italy (2022-03-03 14:30:00 +0100)">Seized Russian superyachts: The first two yachts seized in Italy<img src="https://photo-assets.superyachttimes.com/photo/26871/image/large-1d96660d5af20e9287281ec8d177cb98.jpg" data-gid="gid://syiq/Photo/26871"></a>What is happening to sanctioned yachts?Many people have asked what will happen to vessels if they are seized or arrested by international governments – do they then become the property of those governments, and who will be responsible for the payment of outstanding debts, including the payment of crew?&nbsp;Maltby explained, “It is not yet clear how the vessels will be cared for. They won’t become the property of the governments or port state authorities in whose possession they will remain for the time being. Under English law, you owe a duty of care to the owner of goods you have seized. This is known as a bailment, however it seems unlikely that port officials will be arranging for day workers to clean the yachts down on a daily basis and lacking essential maintenance the value of the vessels will begin to depreciate, while debts build.” As Maltby touched on here, it is not only the outstanding debts incurred by yachts since the sanctions were introduced. Vessels such as <a data-gid="gid://syiq/Yacht/5967" href="#managed-by-system" rel="noopener noreferrer" target="_blank" title="Dilbar156.0m (511'10&quot;)Lürssen Yachts2016">Dilbar</a>, <a data-gid="gid://syiq/Yacht/2485" href="#managed-by-system" rel="noopener noreferrer" target="_blank" title="Amore Vero 85.5m (280'6&quot;)Oceanco2013">Amore Vero</a> and <a data-gid="gid://syiq/Yacht/3527" href="#managed-by-system" rel="noopener noreferrer" target="_blank" title="Lady M65.0m (213'3&quot;)Palmer Johnson Yachts2013">Lady M</a> and <a data-gid="gid://syiq/Yacht/3108" href="#managed-by-system" rel="noopener noreferrer" target="_blank" title="Lena38.5m (126'4&quot;)Sanlorenzo2010">Lena</a> <a data-gid="gid://syiq/Article/54694" href="#managed-by-system" rel="noopener noreferrer" target="_blank" title="Seized Russian superyachts: The first two yachts seized in Italy (2022-03-03 14:30:00 +0100)">which are alleged to have been arrested in Liguria over the weekend</a>, are now sitting in marinas and ports incurring fees which may never be paid.&nbsp;As Jaffa mentioned above, under the sanctions it becomes illegal for people to engage financially with any of the sanctioned individuals. This final point is particularly significant to the yachting industry, and it sheds light on why <a data-gid="gid://syiq/Article/54699" href="#managed-by-system" rel="noopener noreferrer" target="_blank" title="Sanctions imposed against Russian-owned superyacht Dilbar (2022-03-04 09:15:00 +0100)">Dilbar has been named within an official report from the US Department of the Treasury</a>. He added, “<a data-gid="gid://syiq/Yacht/5967" href="#managed-by-system" rel="noopener noreferrer" target="_blank" title="Dilbar156.0m (511'10&quot;)Lürssen Yachts2016">Dilbar</a> was apparently seized during a refit at the <a data-gid="gid://syiq/Company/23" href="#managed-by-system" rel="noopener noreferrer" target="_blank" title="Lürssen Yachts (Company)">Lürssen</a> facility in Hamburg, which may have been due to an ongoing transaction (which is no longer permitted) with a vessel owned by a sanctioned individual. This however should not be expected in the short term. Jaffa added that it is possible for governments to create new legislation that will permit the release of sanctioned assets for the payment of debts, but whether this will be actioned is yet to be seen.In regard to this, some US politicians have been advocating for the seizure of vessels and the subsequent sale of them to raise aid funds. According to BusinessInsider, the so-called “Yachts for Ukraine” Act has been backed by Democratic Rep. Tom Malinowski of New Jersey and Republican Rep. Joe Wilson of South Carolina. The bill would hold authority for two years after its passage but the passing of such an act is yet to be seen.While the repercussions for yacht crew and shipyards with outstanding debts is apparent, it is not only sanctioned individuals who are being impacted. Jaffa explained, “An additionally unsettling impact of the international sanctions, and the war as a whole, is that actions are being taken against non-sanctioned Russians.” The momentary Monégasque arrest of <a data-gid="gid://syiq/Yacht/5625" href="#managed-by-system" rel="noopener noreferrer" target="_blank" title="Quantum Blue104.0m (341'2&quot;)Lürssen Yachts2014">Quantum Blue</a> is an example of this. While she is Russian-owned, the owner of the 104-metre superyacht is not among those wealthy elites named within the sanctions lists, but despite that she was still prevented from departing Port Hercule last week, and though the yacht was later permitted to depart, the event in itself has complicated legal implications.

France-based builder <a data-gid="gid://syiq/Company/416" href="#managed-by-system" rel="noopener noreferrer" target="_blank" title="Ocea (Company)">OCEA</a> has announced that the fourth hull in the <a data-gid="gid://syiq/Company/416" href="#managed-by-system" rel="noopener noreferrer" target="_blank" title="Ocea (Company)">OCEA</a> Commuter 108 yacht series is nearing completion. The temperature is rigorously controlled for the resin to set, and her plastic film is filled with heated air to aid the process. The demand for very large sailing yachts is nothing like that for large motor yachts, but over the last few years there has been increased interest in very large sailing yachts. It does, of course, present some interesting challenges, but Rondal has built its reputation on resolving challenges.&nbsp;Rob Doyle: For a 100-metre sloop in terms of length overall, no, it is not possible. For a 100-metre spar height, yes, that is possible. If someone says ’yes’ to a 100-metre LOA yacht they are out of their depth and have not fully researched all the options involved. At RDD we have done a huge amount of research on this question and we are one of the few naval architects and design studios that have an understanding of the complexibility of such a big rig. Class approval would be difficult, but they will lean hard on the naval architect’s calculations, research and experience.&nbsp;Thys Nikkels: When we are pushing boundaries with any aspect of a design the answer is always ‘Do your homework!’ If you do not have experience with a certain size or configuration you have to do the necessary research and development to prove the design is feasible. Feasible in concept, safe in construction and safe in operation, only then can you tell a client that it is possible, and to do that you have to work with a team of researchers, material specialists, builders to find the required solutions for the challenges.<img src="https://photo-assets.superyachttimes.com/photo/108433/image/large-6f7ee4bb350c7e7604865e0774d55463.jpg" data-gid="gid://syiq/Photo/108433">Are there any suppliers who would take the risk of building such a yacht?Bart van der Meer: We have already built three impressive 70-metre-plus &nbsp;rigs and are currently planning a large rig for an 85-metre sloop, which will become one of the world’s largest.Rob Doyle: There are two really only two manufacturers that can build big rigs. Rigging would be another significant difficulty, along with winches, systems, furling, hull structures, regulations and more.<img src="https://photo-assets.superyachttimes.com/photo/271932/image/large-fe57b0ec686c9fcbbe3f0f91922d0a1d.jpg" data-gid="gid://syiq/Photo/271932">Even if you could build it, would it be safe to operate for the crew?Bart van der Meer: Given the exceptional loads, risk factors for the crew are already an important factor in planning sailing systems for today’s largest sailing yachts, especially when racing. These loads and the sheer length and weight of running rigging do increase exponentially when looking at a rig for a 100-metre sloop. But we should keep in mind that, at this end of the superyacht fleet, only the most highly qualified and experienced crew would manage and trim the sail plan. They would do so with access to very sophisticated load sensors and safety triggers to ensure loads and risks remain within the design boundaries. There is also the possibility that these big rigs could be operated fully automatically. Especially as the cost related to fully automating a sailing system becomes smaller in comparison to the overall cost. However, this route could present new challenges of its own until fully proven.Rob Doyle: We will always design rigs with safe operation in mind, the numbers involved are huge and operation of a sail plan of this size would be very difficult, if not impossible. The size of the systems to control such a rig are significant and very detailed research is required, the sparmakers can build very big rigs – the limit is the yacht not the spar tube.&nbsp;Thys Nikkels: In the end, a large sloop will only work for the client if it can be safely and relatively easily operated by the crew. Otherwise the rig will never, or only sporadically, be used.<img src="https://photo-assets.superyachttimes.com/photo/236181/image/large-38e23873797382eff5e629953f24cb77.jpeg" data-gid="gid://syiq/Photo/236181">Have you had any requests for such a large project and do you expect that one day a client will decide to build one?Rudy Jurg: We have already been introduced to enquiries and concepts of this size that for one reason or another have yet to progress. I have little doubt that 100-metre-plus rigs will be built in the future. The first one will be commissioned by a very ambitious and visionary individual with deep pockets. Once this client’s project is afloat, others are more likely to follow.&nbsp;Rob Doyle: Yes, we have had requests for such yachts a number of times. What we explain first is that the jump from 78-metre M5 to a sloop with a spar length of 100 metres is enormous. If you have not designed and built big rigs before, then a client is very exposed. At RDD we have designed more big rigs, both sloop and ketches, than many other naval architects, but the numbers are staggering when you present the research and the real build numbers. <img src="https://photo-assets.superyachttimes.com/photo/272049/image/large-6060ad9c10f61da7535208d03e662ce4.jpg" data-gid="gid://syiq/Photo/272049">What are the cost implications of building a 100-metre sloop compared with a schooner of similar size?&nbsp;Bart van der Meer: One of the biggest cost implications is that most of the hardware needs to be designed from scratch for the sloop. Nothing on this scale is readily available on the market: no furlers, no toggles, no winches. And it needs to be designed not just bigger, but exponentially bigger. Take a runner winch, for example. From a 30-metre sloop to a 60-metre sloop, the retrieving length will double and the pull force goes from roughly 10 to 30 tonnes. If you want to be able to retrieve the runners at the same time, you’ll need four times more winch power to double the speed and more than double the force.&nbsp;When you recall it was considered doubtful if you could fly a spinnaker from the mast of a 100-foot sloop 30 years ago, we can see that the evolution of marine design technology has always innovated to address such issues. The expertise is there to make the rig of a 100-metre sloop happen, &nbsp;as long as it is accepted that substantial system development costs as well as the hardware manufacturing costs will bear heavily on the first project. For these reasons, it will certainly cost more than the rig of a 100-metre schooner or ketch.Rob Doyle: Hard questions because if you want to be the tip of the sword, a visionary owner that wants to reach for the stars and build the biggest sloop. But you may need to ask yourself: is the ketch a better option at the 100-metre LOA size?<img src="https://photo-assets.superyachttimes.com/photo/236173/image/large-d089b6d8c8cd89662da7e3fc43a4f62c.jpeg" data-gid="gid://syiq/Photo/236173">Given all the factors above and from your own experience, what is the ideal size for a super-sloop?Rudy Jurg: It is difficult to say there is an ideal size, though we do know that the ‘ideal’ size keeps on growing as larger yachts prove their reliability and their capacity to deliver exceptional lifestyle experiences and amenities to owners and their guests. Ultimately the ‘ideal’ will always be related to owners’ plans, their financial resources, their vision and ambition.Rob Doyle: I believe an 85-metre LOA sloop would be the limit, but there are different factors at play that have to be understood and it's more about the length/beam ratio than LOA, which would be a more suitable metric to start with. With war now raging in Ukraine and international governments posing heavy sanctions on Russian companies and oligarchs, questions are being raised about how this war in Europe may impact the superyacht industry. With superyacht crew already being displaced and the supply chain coming under pressure, we take a look at the possible toll on the superyacht industry and all of those who work within it.<img src="https://photo-assets.superyachttimes.com/photo/205458/image/large-6687a12b95045b221a5f21133da703ed.jpg" data-gid="gid://syiq/Photo/205458">Russian owners made up 9% of all superyacht owners in 2021, making them the second largest ownership country behind the United States. While by region Eastern European owners, including Russian and Ukrainian, make up 18%. Russian owners are also the second largest owners of new-build yachts, with 13.2% of the market share of new-build superyachts over 40 metres in 2021-2025 (according to SYT iQ). The Head of Intelligence at SYT wrote in 2021: “The US, Russia, Turkey and the UK remain the most important buyer nations for in-build superyachts over 40 metres,” and this is thrown into a stark light when we consider the possible impact of this war on the yachting industry.With 9% of the market share and some of the largest superyachts in the world (14.7% by volume in 2021), clearly their financial contribution to the industry is significant, particularly in the case of Northern European shipyards. As further sanctions are introduced, will they be able to continue the build of yachts due for launch in the coming years? If not, will we see a number of partially completed 60 metre-plus hulls returning to the market in an echoing of the events following the 2008 financial crisis? There is also an ethical question here about whether shipbuilders will choose to continue their work with Russian owners.But it is not only the new-build market that could be hit. As yachts prepare to return to the water in the coming months ahead of the Mediterranean season, some are speculating that refit yards will be burdened with yachts whose refits have not been paid for. As of today, a number of the largest Russian yachts in the world are sitting in harbours and shipyards across the Mediterranean and questions about their possible seizure continue to raise concerns.Brokers are also concerned about the knock-on impact this could have on the market as a whole, and whether uncertainty about the world economy will make potential owners more cautious of investing in superyachts.<img src="https://photo-assets.superyachttimes.com/photo/100171/image/large-7317203457bc91981793f01da270be03.jpg" data-gid="gid://syiq/Photo/100171">So what are the sanctions and how else could they impact yachting?While the list and severity of sanctions on Russia are changing, the nations within NATO and the EU, as well as Japan, Switzerland, Australia and Taiwan, have all hit Russia with injunctions. Among the most severe sanctions is the banning of the Russian banks from the SWIFT payment network. As a consequence the Russian stock market and currency has plummeted, with the Ruble dropping by more than 30% in value.&nbsp;While this is happening, many countries are freezing the assets of Russian owned companies and oligarchs. The White House tweeted this statement on Wednesday "This coming week, we will launch a multilateral Trans-Atlantic task force to identify, hunt down, and freeze the assets of sanctioned Russian companies and oligarchs - their yachts, their mansions, and any other ill-gotten gains that we can find and freeze under the law." As a result, many Russian-owned superyachts are leaving contentious waters and heading for locations where they are less likely to face seizure, including the Maldives.&nbsp;As these actions progress they could impact the charter market, where a number of Russian owned vessels are among the most coveted charter yachts in the world. A discussion currently on the table among charter brokers is whether owners will put yachts into charter in order to pay crew and vessel fees. Elsewhere stories are emerging of yachts being abandoned by crew.There are also questions being raised about how best to protect crew working on Russian and Ukrainian yachts in the case of owners falling into financial difficulties. The Nautilus International institute, the union for seafarers, is urging crew members to get in touch in the case that sanctions imposed on owners impact their salaries.&nbsp;Beyond possible payment issues caused by sanctions, it is also likely that crew from all over the world will no longer wish to work on Russian owned yachts. Facebook groups dedicated to Russian-speaking crew have been inundated with messages of support for Ukrainian colleagues, but also with Russian crew looking for new positions. One Facebook group called ‘Russian speaking yacht crew’ has shut down, with the founder citing “In light of recent events, this group should no longer exist.”&nbsp;Crewing agencies have widely bemoaned the lack of experienced crew over the past year; the possibility that Russian owned yachts will have even greater difficulty finding crew members raises concerns about whether some yachts will be operable. Crew safety is also in question and the publication of yacht owners’ occupations, home addresses and yacht names is adding kindling to the flames. With vandalisation of Russian owned assets beginning to be seen, some crew members may be at risk.&nbsp;With the condemnation of Russian supporters being widely shared across the globe and international corporations shutting down business with Russia, other firms have begun to boycott Russian owned yachts. Stories are emerging of companies refusing to distribute supplies to superyachts. If true, this will impact those yachts put into charter as owners and management teams attempt to use charter as a means to allay costs. &nbsp;While this story continues to develop, the implications – both ethical and practical – for the superyacht industry and all those who work within it will become pronounced and possibly more divisive.&nbsp;
