As a result of this, the judge did not dismiss the case because Boats Group lacks market power.However, the judge said that Brill Maritime had failed to show that Boats Group engaged in illegal anticompetitive conduct and under US antitrust law, being a monopoly is not illegal by itself.The court repeatedly emphasised that monopoly power is legal, but using that power through anticompetitive behaviour to exclude rivals is illegal.&nbsp;The judge found that Brill Maritime’s three main allegations were insufficient including that Boats Group became dominant by acquiring competitors such as YachtWorld.com, boats.com and YachtCloser.com.The judge said that acquiring competitors is not necessarily illegal and that Brill Maritime had not explained how these acquisitions had harmed competition. The complaint had described the acquisitions as “strategic” suggesting it was more of a successful business move than illegal conduct. The judge explained that Brill Maritime had shown that Boats Group bought competitors, but not that these acquisitions were unlawful. <img src="https://photo-assets.superyachttimes.com/photo/355039/image/large-513a0ee840e10e5371f647093bba58d9.jpg" data-gid="gid://syiq/Photo/355039">Brill Maritime also claimed that Boats Group's subscription agreements stoped brokers from listing boats elsewhere. TISG and RYI have announced the delivery of the first Picchiotti Gentleman 24M yacht, which has been christened Gentleman.
