It was Galassi's opinion that the base auction price outweighed the value of the brand name and that the amount of money needed to restart the company, no matter its reputation, would be untenable.&nbsp;It will now be up to a judge to set a third auction date and to set another price for the value of the shipyard and its assets.

As a result of this, the judge did not dismiss the case because Boats Group lacks market power.However, the judge said that Brill Maritime had failed to show that Boats Group engaged in illegal anticompetitive conduct and under US antitrust law, being a monopoly is not illegal by itself.The court repeatedly emphasised that monopoly power is legal, but using that power through anticompetitive behaviour to exclude rivals is illegal.&nbsp;The judge found that Brill Maritime’s three main allegations were insufficient including that Boats Group became dominant by acquiring competitors such as YachtWorld.com, boats.com and YachtCloser.com.The judge said that acquiring competitors is not necessarily illegal and that Brill Maritime had not explained how these acquisitions had harmed competition. The complaint had described the acquisitions as “strategic” suggesting it was more of a successful business move than illegal conduct. The judge explained that Brill Maritime had shown that Boats Group bought competitors, but not that these acquisitions were unlawful. <img src="https://photo-assets.superyachttimes.com/photo/355039/image/large-513a0ee840e10e5371f647093bba58d9.jpg" data-gid="gid://syiq/Photo/355039">Brill Maritime also claimed that Boats Group's subscription agreements stoped brokers from listing boats elsewhere. The judge examined the contract language and concluded that the provision merely prevented brokers from implying that a YachtWorld or Boats Group listing originated somewhere else. He therefore concluded that you can advertise on YachtWorld and on other sites and the contract simply prevented you from pretending a Boats Group listing came from another platform, meaning the clause is not an exclusive dealing arrangement.Finally, Brill Maritime argued that Boats Group had dramatically increased its prices. The judge responded that high prices alone are not an antitrust violation. The court cited multiple precedents saying a legal monopolist is generally allowed to charge whatever prices it wants. To prove monopolisation, Brill Maritime needed to show that the higher prices resulted from illegal exclusionary conduct.In conclusion, the judge accepted that Boats Group may hold monopoly power in the US online boat-listing market, but ruled that the plaintiffs failed to show that Boats Group acquired or maintained that position through illegal anticompetitive conduct.United States District Judge, Roy K. Altman dismissed the complaint without prejudice, meaning the plaintiff is able to resubmit an amended complaint, with a deadline of 30 June 2026.&nbsp;The lawsuit also contained claims under Florida law, with the federal court declining to hear the state claims as the federal antitrust claims were dismissed. Since last May, the <a data-gid="gid://syiq/Company/51" href="#managed-by-system" rel="noopener noreferrer" target="_blank" title="Perini Navi (Company)">Perini Navi</a> shipyard has faced an uncertain future. Having first been declared bankrupt with a reported loss of €80,870,000 at the end of 2019, the Italian sailing yacht builders were of interest to fellow shipyard <a data-gid="gid://syiq/Company/374" href="#managed-by-system" rel="noopener noreferrer" target="_blank" title="Sanlorenzo (Company)">Sanlorenzo</a>, but <a href="https://www.superyachttimes.com/yacht-news/perini-navi-blue-skye" rel="noopener noreferrer" target="_blank" title="">more recently was due to be acquired by the Blue Skye Investment Group.</a>&nbsp;Now with exposed debts of over €100,000,000, <a data-gid="gid://syiq/Company/51" href="#managed-by-system" rel="noopener noreferrer" target="_blank" title="Perini Navi (Company)">Perini Navi</a> was heavily reliant on <a href="https://www.superyachttimes.com/yacht-news/perini-navi-investors" rel="noopener noreferrer" target="_blank" title="">the restructuring plan offered by Blue Skye</a> which guaranteed a four-year loan of €30,000,000 at a rate of 12% with pre-tax deductions on all goods owned by the shipyard. At this point, the only option to save <a data-gid="gid://syiq/Company/51" href="#managed-by-system" rel="noopener noreferrer" target="_blank" title="Perini Navi (Company)">Perini Navi</a> is through a bankruptcy auction procedure, which is said to be still of interest to <a data-gid="gid://syiq/Company/374" href="#managed-by-system" rel="noopener noreferrer" target="_blank" title="Sanlorenzo (Company)">Sanlorenzo</a> and the <a data-gid="gid://syiq/Company/361" href="#managed-by-system" rel="noopener noreferrer" target="_blank" title="Ferretti Yachts (Company)">Ferretti</a> Group. Most recently, the <a data-gid="gid://syiq/Company/5565" href="#managed-by-system" rel="noopener noreferrer" target="_blank" title="The Italian Sea Group (Company)">Italian Sea Group</a> has expressed interest in the failing brand, which they say "represents a strategic interest, also for Italy itself". Also, <a data-gid="gid://syiq/Company/1757" href="#managed-by-system" rel="noopener noreferrer" target="_blank" title="Palumbo Superyachts (Company)">Palumbo Superyachts</a> is the latest industry player intending to participate in the auction procedure.&nbsp; <img src="https://photo-assets.superyachttimes.com/photo/121695/image/large-fc60fc8141ace7fe4a998b6551f5d1d5.jpg" data-gid="gid://syiq/Photo/121695">MF-Milano Finanza reported that: "The two contenders will aim at obtaining the lease of the business unit and subsequently purchasing the company and the brands. Is Perini Navi bankrupt? As the court case continues, Italian press MF-Milano Finanza share the latest. 

The Perini Navi case continues: Bankruptcy declared

The <a data-gid="gid://syiq/Company/4876" href="#managed-by-system" rel="noopener noreferrer" target="_blank" title="Ferretti Group (Company)">Ferretti Group</a> and <a data-gid="gid://syiq/Company/374" href="#managed-by-system" rel="noopener noreferrer" target="_blank" title="Sanlorenzo (Company)">Sanlorenzo</a> have announced that they deem the <a data-gid="gid://syiq/Company/51" href="#managed-by-system" rel="noopener noreferrer" target="_blank" title="Perini Navi (Company)">Perini Navi</a> auction starting price of €62.5 million to be too high for the real value of the assets. Though the partnership have expressed keen interest in the purchasing of <a data-gid="gid://syiq/Company/51" href="#managed-by-system" rel="noopener noreferrer" target="_blank" title="Perini Navi (Company)">Perini Navi</a>, its shipyard, real estate and in the retention of its staff, they stated; “While extremely interested in the acquisition of <a data-gid="gid://syiq/Company/51" href="#managed-by-system" rel="noopener noreferrer" target="_blank" title="Perini Navi (Company)">Perini Navi</a> and the implementation of an important relaunch plan, in consideration of the fixed auction base, <a data-gid="gid://syiq/Company/4876" href="#managed-by-system" rel="noopener noreferrer" target="_blank" title="Ferretti Group (Company)">Ferretti Group</a> and <a data-gid="gid://syiq/Company/374" href="#managed-by-system" rel="noopener noreferrer" target="_blank" title="Sanlorenzo (Company)">Sanlorenzo</a> reserve the right - albeit painful - not to participate in the auction announced by the curator for the July 30, 2021.”<img src="https://photo-assets.superyachttimes.com/photo/109145/image/large-866f8accfb4b75858dde9fd2fb0a4a03.jpg" data-gid="gid://syiq/Photo/109145">The <a data-gid="gid://syiq/Company/4876" href="#managed-by-system" rel="noopener noreferrer" target="_blank" title="Ferretti Group (Company)">Ferretti Group</a> and <a data-gid="gid://syiq/Company/374" href="#managed-by-system" rel="noopener noreferrer" target="_blank" title="Sanlorenzo (Company)">Sanlorenzo</a> are willing to invest substantially in the assets, but they believed that the considerable amount of investment necessary to truly rescue and rejuvenate the legendary yard, was not considered when the starting price was set.
