It was discussed whether the lower court judge made an error, rather than conducting its own fresh assessment. The courts had previously recognised the significant interference with the owner's property rights, but had found the detention to be justified based on the government's legislative objectives.The regulations only require the government to state the "grounds" for detention, not provide detailed "reasons". The court had previously found the government's statement of the statutory basis for detention was sufficient, even without additional explanation.A key issue in the case was whether the government's actions amounted to "conversion," which means illegally taking someone’s property. To prove conversion, the government would have to completely deny Mr. Naumenko’s rights to his yacht. But the government only restricted the yacht’s use, not ownership.&nbsp;Following a total hearing of five and a half hours, the court was dismissed and the hearing will now await judgement, which is expected to take between six to eight weeks.&nbsp;Also running alongside the Dalston Projects Ltd case is the Shvidler v Secretary of State for Foreign, Commonwealth and Development Affairs case, where Eugene Shvidler is appealing a decision to keep him designated as a sanctioned individual under UK regulations targeting Russia, based on his past business connections to Roman Abramovich and Evraz plc.
