The United States District Court for the Southern District of Florida has dismissed the entire complaint brought by Export Yacht Sales (Brill Maritime), which alleged that Boats Group illegally monopolised the US online boat-listing market through YachtWorld, Boat Trader and boats.com.<img src="https://photo-assets.superyachttimes.com/photo/355047/image/large-0bd8f332392990f5a08cac6ea37b81d1.jpg" data-gid="gid://syiq/Photo/355047">The lawsuit was filed on 14 August 2025, with Brill Maritime alleging that Boats Group controlled approximately 75 percent of the market for listing and marketing recreational boats and used subscription agreements that either bar or discourage brokers and dealers from listing vessels on rival platforms.Read more: <a data-gid="gid://syiq/Article/64073" href="#managed-by-system" rel="noopener noreferrer" target="_blank" title="US boat dealers bring antitrust class action against Boats Group (2025-08-21 13:00:00 +0200)">US boat dealers bring antitrust class action against Boats Group</a><img src="https://photo-assets.superyachttimes.com/photo/355053/image/large-d4b378b0bbe9bf56a1926a2d570b4fd5.jpg" data-gid="gid://syiq/Photo/355053">According to Brill Maritime, competing platforms had been unable to achieve the scale or inventory to grow their services effectively, leaving brokers and dealers with limited options.The court found that Brill Maritime had plausibly alleged that the relevant market could be defined as an online boat listing and marketing service in the United States and that Boat Group may possess monopoly power in that market.&nbsp;Brill Maritime also alleged that Boat’s Group claimed 75 percent of the global share, reasonably supporting an inference that it has a dominant position in the US market. As a result of this, the judge did not dismiss the case because Boats Group lacks market power.However, the judge said that Brill Maritime had failed to show that Boats Group engaged in illegal anticompetitive conduct and under US antitrust law, being a monopoly is not illegal by itself.The court repeatedly emphasised that monopoly power is legal, but using that power through anticompetitive behaviour to exclude rivals is illegal.&nbsp;The judge found that Brill Maritime’s three main allegations were insufficient including that Boats Group became dominant by acquiring competitors such as YachtWorld.com, boats.com and YachtCloser.com.The judge said that acquiring competitors is not necessarily illegal and that Brill Maritime had not explained how these acquisitions had harmed competition. The complaint had described the acquisitions as “strategic” suggesting it was more of a successful business move than illegal conduct. The judge explained that Brill Maritime had shown that Boats Group bought competitors, but not that these acquisitions were unlawful. <img src="https://photo-assets.superyachttimes.com/photo/355039/image/large-513a0ee840e10e5371f647093bba58d9.jpg" data-gid="gid://syiq/Photo/355039">Brill Maritime also claimed that Boats Group's subscription agreements stoped brokers from listing boats elsewhere. The judge examined the contract language and concluded that the provision merely prevented brokers from implying that a YachtWorld or Boats Group listing originated somewhere else. He therefore concluded that you can advertise on YachtWorld and on other sites and the contract simply prevented you from pretending a Boats Group listing came from another platform, meaning the clause is not an exclusive dealing arrangement.Finally, Brill Maritime argued that Boats Group had dramatically increased its prices. The judge responded that high prices alone are not an antitrust violation. The court cited multiple precedents saying a legal monopolist is generally allowed to charge whatever prices it wants. To prove monopolisation, Brill Maritime needed to show that the higher prices resulted from illegal exclusionary conduct.In conclusion, the judge accepted that Boats Group may hold monopoly power in the US online boat-listing market, but ruled that the plaintiffs failed to show that Boats Group acquired or maintained that position through illegal anticompetitive conduct.United States District Judge, Roy K. Altman dismissed the complaint without prejudice, meaning the plaintiff is able to resubmit an amended complaint, with a deadline of 30 June 2026.&nbsp;The lawsuit also contained claims under Florida law, with the federal court declining to hear the state claims as the federal antitrust claims were dismissed. Italian yacht builder Ferretti Group has denied rumours that they had a possible interest in acquiring The Italian Sea Group (TISG).

Italian yacht builder <a data-gid="gid://syiq/Company/4876" href="#managed-by-system" rel="noopener noreferrer" target="_blank" title="Ferretti Group (Company)">Ferretti</a> has announced that the KKCG owned shareholder Azúr a.s. has initiated legal proceedings challenging the appointment of the new board of directors at the company's shareholders' meeting on 14 May 2026.<img src="https://photo-assets.superyachttimes.com/photo/394210/image/large-3bfd53739fbb59d4d9e5f0968bf4da9e.jpg" data-gid="gid://syiq/Photo/394210">According to a statement released by <a data-gid="gid://syiq/Company/4876" href="#managed-by-system" rel="noopener noreferrer" target="_blank" title="Ferretti Group (Company)">Ferretti</a> on 11 June, Azúr filed a writ of summons before the Court of Bologna on 9 June 2026 pursuant to Articles 2377 and 2378 of the Italian Civil Code.Azúr a.s. is a wholly owned part of KKCG’s global business, founded by Czech entrepreneur Karel Komárek. They bring together all of KKCG Maritime’s assets into a single entity and currently have a 23.23 percent stake in the <a data-gid="gid://syiq/Company/4876" href="#managed-by-system" rel="noopener noreferrer" target="_blank" title="Ferretti Group (Company)">Ferretti Group</a>.&nbsp;Azúr is currently seeking nullity and/or annulment of resolutions concerning the appointment of <a data-gid="gid://syiq/Company/4876" href="#managed-by-system" rel="noopener noreferrer" target="_blank" title="Ferretti Group (Company)">Ferretti</a>'s new board of directors, the determination of the number of board members and the appointment of the company's board of statutory auditors.They have also requested interim relief from the court to suspend the effectiveness of those resolutions pending the outcome of the proceedings. <a data-gid="gid://syiq/Company/4876" href="#managed-by-system" rel="noopener noreferrer" target="_blank" title="Ferretti Group (Company)">Ferretti</a> have responded stating that they will take the necessary steps to defend its position.&nbsp;“<a data-gid="gid://syiq/Company/4876" href="#managed-by-system" rel="noopener noreferrer" target="_blank" title="Ferretti Group (Company)">Ferretti</a>, having taken note of the service of the writ of summons, will protect its rights and will seek appropriate legal advice to defend and will have the absolute correctness of its conduct ascertained before the competent Court.”<a data-gid="gid://syiq/Company/4876" href="#managed-by-system" rel="noopener noreferrer" target="_blank" title="Ferretti Group (Company)">Ferretti</a> confirmed that its corporate bodies remain fully operational and continue to perform their respective duties and responsibilities. <a data-gid="gid://syiq/Company/5565" href="#managed-by-system" rel="noopener noreferrer" target="_blank" title="The Italian Sea Group (Company)">The Italian Sea Group (TISG)</a> has announced that the Court of Florence has partially lifted protective measures for five shipowners, following the company's ongoing negotiated crisis settlement procedure.<img src="https://photo-assets.superyachttimes.com/photo/367061/image/large-152c0f12c19271f70607c9687ef33098.jpg" data-gid="gid://syiq/Photo/367061">On 16 March, <a data-gid="gid://syiq/Company/5565" href="#managed-by-system" rel="noopener noreferrer" target="_blank" title="The Italian Sea Group (Company)">TISG</a> announced that it had initiated a negotiated settlement procedure under Italian Legislative Decree No. 14/2019, following internal financial irregularities. This legal framework aimed to enable them to restructure, while continuing to operate under the supervision of an independent expert.Following this, on 20 April, the Court of Florence granted protective measures for a maximum period of four months, restricting creditors from initiating or continuing enforcement actions against the company’s assets, including vessels currently under construction.The court also confirmed that these protective measures extended to shipowners, which prevented them from terminating their contracts of yachts currently under construction during the proceedings.The Court of Florence has now issued an order upholding the appeals filed by five shipowners which prevented them terminating their contracts. “Without data you’re just a person with an opinion,” says Giovanni Palamà. For the data &amp; measurement specialist, entrepreneur, and founder of <a data-gid="gid://syiq/Company/8890" href="#managed-by-system" rel="noopener noreferrer" target="_blank" title="SailADV Group (Company)">SailADV</a>, the quote is not a provocation – it is the premise on which he built an entire company.&nbsp;After years as a professional sailor on the international race circuit, Giovanni Palamà understands that performance on the water is never the product of instinct alone: it is the result of consistent, objective and repeatable measurement.&nbsp;“When I left racing and moved into consultancy, I realised the superyacht industry lacked this scientific discipline,” he says. “Extremely complex vessels were being delivered, yet there was no standardised way to quantify whether they actually performed according to their design. Size isn’t an issue for us. We have the capacity, infrastructure and expertise to build big boats and are currently working on a 180-metre cruise ship. There is an expansive list prior to this build, but our most recently launched was the 140-metre Roald Amundsen which has an interior volume of around 20,889 GT.” <img src="https://photo-assets.superyachttimes.com/photo/217379/image/large-54e4df45efef5341c1af7f0b84ead456.jpeg" data-gid="gid://syiq/Photo/217379">The focus of this energised drive into the superyacht market will be concentrated on larger builds and the above 80 metre category, which, as Russel Crump, a consultant to <a data-gid="gid://syiq/Company/206" href="#managed-by-system" rel="noopener noreferrer" target="_blank" title="Yachting Partners International (Company)">YPI</a>, previously said, is a market segment that has seen a 22 percent growth in recent years. Even though there is a growing demand for yachts of this size, there are only 152 yachts out of the 7800 superyachts currently in operation of this size – <a data-gid="gid://syiq/Company/2996" href="#managed-by-system" rel="noopener noreferrer" target="_blank" title="Kleven Maritime AS (Company)">Green Yard Kleven</a> may find their order books filling up pretty quickly.<img src="https://photo-assets.superyachttimes.com/photo/43445/image/large-4aada240d469e6f453676f58449d158e.jpg" data-gid="gid://syiq/Photo/43445">“We’re ready,” Fedog confirmed. “<a data-gid="gid://syiq/Company/2996" href="#managed-by-system" rel="noopener noreferrer" target="_blank" title="Kleven Maritime AS (Company)">Green Yard Kleven</a> is in great shape at the moment and we’ve hardly been affected by recent supply chain issues. Our current output is around 10 vessels a year, so not only do we have the capacity for multiple large projects, which can be started pretty much immediately, but we also have a strong team, sufficient reserves of materials and the ability to complete our builds in a relatively short time. Our turnaround is vastly quicker than our competitors.”&nbsp;When pressed whether the shipyard is only interested in the top-end of the superyacht sector, Fedog confessed that “though we believe there is a higher demand for this area of the market, if a client was to ask for a smaller yacht then, of course, we’d be more than happy to meet their demands. We can also go bigger, too. So if a client was interested in a ‘residential superyacht’, this is also something within our remit. Size really isn’t an issue for us. Our commitment is to build the best yachts, in terms of quality and strength, that come out of Norway. So, regardless of size, this will be the <a data-gid="gid://syiq/Company/2996" href="#managed-by-system" rel="noopener noreferrer" target="_blank" title="Kleven Maritime AS (Company)">Green Yard Kleven</a> promise.”<img src="https://photo-assets.superyachttimes.com/photo/19598/image/large-d702400e5feaada7d58748798143ccd6.jpg" data-gid="gid://syiq/Photo/19598">The <a data-gid="gid://syiq/Company/2996" href="#managed-by-system" rel="noopener noreferrer" target="_blank" title="Kleven Maritime AS (Company)">Green Yard Kleven</a> shipyard looks onto perhaps the least forgiving body of water in the world: the North Sea. Therefore every vessel that leaves the facility needs to be extremely solid and capable of withstanding the temperature and temperament of these waters. Strength, then, is very much a part of the Kleven DNA.&nbsp;“We also embed the ‘green’ element of <a data-gid="gid://syiq/Company/2996" href="#managed-by-system" rel="noopener noreferrer" target="_blank" title="Kleven Maritime AS (Company)">Green Yard Kleven</a> into all of our builds,” Fedog explained. “We’ve made strides with our green technology in terms of propulsion systems and with our inhouse machinery. Our clients frequently voice how important feeling the natural atmosphere of the sea is, and not the vibrations of the vessel – and we’ve worked hard to deliver this, every time.”<img src="https://photo-assets.superyachttimes.com/photo/65382/image/large-f738289defb38432279b5df3c5e1416e.jpg" data-gid="gid://syiq/Photo/65382">The news that Norway has great deposits of vanadium – a much favourable mineral for batteries over lithium-ion, as they can be charged faster, are more durable and are much easier to recycle – is also likely to weigh favourably for <a data-gid="gid://syiq/Company/2996" href="#managed-by-system" rel="noopener noreferrer" target="_blank" title="Kleven Maritime AS (Company)">Green Yard Kleven</a>. With such reserves of what is frequently cited as the ‘most important raw material of the future’, we can likely expect waves to be made in propulsion R&amp;D from the shipyard. As of yet, vanadium hasn’t made much of an appearance in the yachting industry, but we can speculate that if one yard is going to be a driver of it, it will be <a data-gid="gid://syiq/Company/2996" href="#managed-by-system" rel="noopener noreferrer" target="_blank" title="Kleven Maritime AS (Company)">Green Yard Kleven</a>.&nbsp;

Cassetta (Company)">Giorgio M Cassetta</a> has penned the yachts sleek exterior lines, while <a data-gid="gid://syiq/Company/212" href="#managed-by-system" rel="noopener noreferrer" target="_blank" title="Benetti SpA (Company)">Benetti</a>'s own style department created her interior design.
